General Terms and Conditions
valid from 01.07.2023
1. all prices are net prices on which VAT is shown and payable at the statutory rate. In order to be able to issue invoices from EU exhibitors without VAT, their VAT number is required. The prices are free delivery and collection at the exhibition stand. This applies to all exhibition venues that we supply as a service partner. For all other trade fair venues and deliveries abroad, transportation costs may apply.
From 15.04.2022, we will charge a mobility surcharge of 3% for deliveries within Germany and 5% for deliveries to other European countries. This surcharge also applies to trade fair locations where a service partnership exists.
2 The rental price is valid for the entire duration of the event. Special conditions will be agreed for longer rental periods.
Cancellation of the contract by the lessee is possible as follows: between 30 and 15 days before the start of the trade fair/event: 50% of the net rental price will be charged. From 14 days before the start of the trade fair: 100% of the net rental price will be charged. The rented property is only made available for the agreed period, i.e. the duration of the event.
Additional conditions in the event of a pandemic:
If trade fairs are officially canceled(up to 8 days before the start of the trade fair), we do not charge any cancellation fees
From 7 days before the start of the trade fair, we will charge 30% for the provision and loading already completed.
If the cancellation is made when we are already on site and may have started delivery, we will charge 70% accordingly.
3. the exhibitor's liability for loaned items begins with delivery to the stand and ends with collection. This also applies if the stand is not occupied. The rented furniture must be ready for collection at the end of the event and complete (including gratings and vegetable trays) and must not be locked in the booths under any circumstances. If access to our property is not guaranteed after the end of the event in breach of contract, i.e. if the rented items are locked up, the exhibitor shall be liable without limitation and shall be obliged to secure the items and return them to the lessor free of charge. If the rented items are not returned on time, the lessor may demand the agreed rent as compensation for the period for which they were withheld. Further compensation is not excluded.
4 The rented property is not insured. The hirer shall be liable for the replacement value of any rental items that are lost (without recognition of a deduction for current value). In the event of damage, he must reimburse the repair costs up to the amount of the replacement value. The conclusion of a theft insurance is absolutely necessary.
5. a complaint by the tenant must be made within 24 hours. Later complaints will not be accepted. The Hirer is aware that the rented property is used several times and is not always as good as new. Normal signs of use resulting from the use of the goods as rental property do not constitute grounds for complaint. The hirer is obliged to report any damage to the furniture by himself or third parties immediately. The same applies in the event of theft. In exceptional cases, the Lessor reserves the right to provide the Lessee with equivalent furniture in the corresponding price category instead of the furniture ordered. This also applies to orders received late.
6. the rental furniture is and remains the property of the lessor and cannot be seized. It shall only be used for the intended purpose at the respective event. Any other use during the same period or thereafter is not permitted. The hirer must be notified immediately if the rented items are moved to another location (exhibition stand) or venue, as the hirer must be held liable in the event of loss. The same applies to loading by stand builders, stand designers or similar companies commissioned by the exhibitor. If external companies transport the equipment, they are liable for all damage to the rented equipment (damage, loss, etc.).
7 When installing refrigerators and freezers, make sure that they have a sufficient air supply. Installation and covering of the appliances and covering of the ventilation slots must be avoided. A night-time power connection is required for refrigerators and freezers. The regular emptying of the condensation water containers must be ensured. The lessor accepts no liability for condensation damage. After the end of the event, the refrigerated goods must be removed from the units in good time. On collection, the beverages and goods still contained therein shall be deposited on the stand at the lessee's risk. Any liability on the part of the lessor for their loss is excluded. Any liability on the part of Valentin Internationaler Messeservice GmbH & Co. KG for damage to refrigerated goods, loss of business, loss of profit is excluded.
8 Our technical on-site service only applies to equipment deployed within Germany. This does not apply to foreign trade fairs that are supplied directly by us (e.g. SIAL-Paris, PLMA-Amsterdam).
9. the General Terms and Conditions of Hire and Business apply in all cases to all orders, including orders placed by telephone, fax, e-mail or verbally.
10 Mettmann is agreed as the place of jurisdiction. As far as permissible, the parties agree on German law.
